End User License Agreement

Android App Licence Google Play Distribution Effective January 2025

This End User License Agreement ("EULA") is a legal agreement between you ("End User" or "you") and Sarvaantar AI Solutions Pvt. Ltd. ("Sarvaantar") governing your use of the Sarvaantar mobile application (the "App") and associated software. By installing or using the App, you agree to be bound by this EULA. If you do not agree, do not install or use the App.

1. Grant of License

Subject to your compliance with the terms and conditions of this EULA and any applicable subscription agreement between your employing organisation and Sarvaantar, Sarvaantar hereby grants you a limited, non-exclusive, non-transferable, revocable licence to:

  • Download, install, and use one copy of the App on a single Android device that you personally own or control.
  • Access the features and functions of the App strictly for your organisation's internal business purposes, within the scope of the role and permissions assigned to you by your company administrator.
  • Use the App only in accordance with this EULA, the Sarvaantar Terms and Conditions, and applicable law.

This licence does not include any right to sublicense the App to third parties, to use the App in a service bureau or time-sharing arrangement, or to use the App for any purpose other than as expressly permitted herein. All rights not expressly granted are reserved by Sarvaantar.

2. Restrictions

You expressly agree that you shall not, and shall not permit any third party to:

  • Copy or reproduce: Copy, reproduce, distribute, or create derivative works of the App or any part of it, except as expressly permitted by this EULA.
  • Modify or adapt: Modify, translate, adapt, or create derivative works based on the App or any part of its source code, user interface, or documentation.
  • Reverse engineer: Reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying algorithms, architecture, or trade secrets of the App by any means whatsoever.
  • Sublicense or transfer: Sublicense, sell, rent, lease, loan, transfer, assign, or otherwise dispose of the App or any rights therein to any third party.
  • Remove notices: Remove, obscure, or alter any proprietary notices, labels, branding, watermarks, or trademarks on or within the App.
  • Circumvent security: Attempt to circumvent, bypass, or disable any security, authentication, access control, or digital rights management feature of the App.
  • Unauthorised access: Use the App to gain unauthorised access to data belonging to other users, organisations, or third parties.
  • Commercial exploitation: Use the App to develop competing products or services, or for any commercial purpose other than your organisation's internal operations under a valid Sarvaantar subscription.

3. Updates & Upgrades

Sarvaantar may from time to time release updates, patches, bug fixes, or new versions of the App ("Updates") through the Google Play Store or directly through the App's in-app update mechanism. These Updates may include security fixes, new features, performance improvements, or modifications to existing functionality.

  • Automatic updates: If you have enabled automatic updates on your device or the App, Updates may be installed automatically without further notice.
  • Acceptance: Your continued use of the App following the release of an Update constitutes your acceptance of the modified EULA and any updated terms that accompany the Update.
  • Obligation: You are strongly encouraged to keep the App updated to the latest version to benefit from security patches and the latest features. Sarvaantar may, at its discretion, discontinue support for older versions of the App and require you to upgrade to continue using the service.
  • Backward compatibility: Sarvaantar will endeavour to maintain backward compatibility in Updates, but cannot guarantee that all features will be available in all versions or on all Android device configurations.

4. Data Collection

The App collects certain personal and device data to function correctly. By installing and using the App, you acknowledge and consent to the collection and use of your data as described in our Privacy Policy. Key data collected includes:

  • GPS location at clock-in and clock-out events for geo-fenced attendance verification.
  • Device identifiers for security and session management.
  • Photographs and site documentation captured through the in-app camera.
  • Usage analytics (anonymised) for product improvement.

You have the right to withdraw consent for certain data collection by revoking the relevant permissions in your Android device settings, with the understanding that some features will cease to function. See our Privacy Policy for full details.

5. Android App – Specific Terms

The Sarvaantar App is distributed through the Google Play Store operated by Google LLC. By downloading or using the App through Google Play, you also agree to be bound by Google's Terms of Service and the Google Play Terms of Service, in addition to this EULA. In the event of any conflict between this EULA and Google's terms, this EULA shall govern to the extent that the conflict relates solely to the App.

  • Device requirements: The App requires Android 8.0 (Oreo) or higher. Optimal performance is achieved on Android 10 or higher with at least 3 GB of RAM.
  • Google Play distribution: Sarvaantar is solely responsible for the App and its content. Google is not a party to this EULA and bears no responsibility for the App, its maintenance, or any claims related to it.
  • Permissions: The App requests certain device permissions as listed in the Google Play Data Safety section and our App Permissions Guide. Granting permissions is required for specific features to function.
  • Third-party services: The App may use third-party SDKs (such as Firebase) which are subject to their own terms of service and privacy policies.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

Sarvaantar does not warrant that: (a) the App will meet your specific requirements; (b) the App will operate without interruption or be error-free; (c) defects will be corrected; or (d) the App or the servers that make it available are free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you in full. In such cases, Sarvaantar's warranties are limited to the minimum required by applicable law.

7. Termination

This licence is effective until terminated. Your rights under this EULA will terminate automatically and without notice if:

  • You fail to comply with any term of this EULA.
  • Your employing organisation's subscription with Sarvaantar expires or is terminated.
  • Your company administrator deactivates your user account.
  • You uninstall the App from your device.

Upon termination, you must immediately cease all use of the App and delete all copies of it from your device. Termination of this EULA does not affect any rights or obligations that accrued prior to termination, including Sarvaantar's rights to enforce any breach.
